The Businesses That Scale AI Will Be the Ones That Built Governance First

By the end of 2026, AI governance will shift from a "nice to have" to a competitive differentiator and, increasingly, a buying condition.
As more businesses understand the real risks associated with AI, data exposure, hallucination, third-party model risk, regulatory liability, they will start asking their partners and vendors a question that most are not yet ready to answer: what does your AI governance look like?
That question is coming. The businesses that can answer it clearly will win work. The ones that cannot will lose trust.
What Europe made clear
I wrote the first three posts in this series before spending time working from London in February. The intent was always to pressure-test my thinking against what I saw on the ground. On governance, the gap between Europe and Australia was larger than I expected.
The EU AI Act is live and being enforced, with obligations across risk categories that apply to any business operating in or selling into Europe. Businesses there are not treating governance as a side project. It is embedded in how they evaluate, procure, and deploy AI.
But what struck me was not just the regulation. It was the culture of governance thinking.
Organisations with existing governance muscle handle AI governance materially better.
The businesses that had already built internal rigour around data ownership, risk assessment, and accountability, often driven by years of GDPR compliance, were not starting from scratch when AI governance arrived.
They had the scaffolding. That gave them a meaningful leg up, not just in compliance, but in the thinking required to assess risk and reward across different lenses.
When I raised the questions outlined in the final post of this series with leaders across the UK, they did not just nod politely. They engaged. They talked about how their organisations were already grappling with these ideas, where they were stuck, and what was not working.
That was a materially different quality of conversation to what I often encounter in Australia, where the more common response is still: "That is interesting. I had not thought about that."
That is not a criticism of Australian businesses. It is a reflection of where the conversation is at. And it is a gap worth closing, because it has direct commercial consequences.
Australia is building governance from a cold start
In Australia, many organisations are trying to build AI governance with no or limited prior muscle memory. There has been no equivalent forcing function to GDPR.
The result is that businesses are being asked to adopt new technology and new accountability structures at the same time. That is significantly harder than layering AI governance onto an existing foundation.
The direction, however, is clear. The National AI Centre's Guidance for AI Adoption (AI6) outlines six essential practices for responsible AI use:
Decide who is accountable
Understand impacts and plan accordingly
Measure and manage risks
Share information
Test and monitor
Maintain human control
These six practices are not regulation. They are voluntary. But they represent the trajectory Australian governance is on, and they provide a practical, accessible baseline that any business can start with today.
The businesses that build governance now will be ready when regulation arrives. Those that wait will be retrofitting under pressure -- which is more expensive, more disruptive, and more likely to fail.
Governance is not a cost centre, it is the enabler
This is the reframe that matters.
Governance is not a brake on AI adoption. It is the thing that lets you scale AI with confidence. It is what allows you to win trust with customers and partners. It is what enables you to move faster, precisely because you have guardrails in place and know where the boundaries are.
Imagine you are selecting an AI vendor for your customer communications pipeline. You ask them how they handle data privacy, model risk, and accountability. One vendor gives you a clear, documented answer with policies, risk frameworks, and audit trails. The other says they are "working on it." Who do you choose?
Now imagine your clients are asking you the same question. Can you answer it?
That is the buying condition that is emerging. And it will only accelerate as AI moves deeper into core business operations, where the cost of getting it wrong is not a bad email draft but a regulatory breach, a data leak, or a decision that cannot be explained.
What you can do now
You do not need to wait for regulation to start.
The AI6 framework provides six clear practices. Start with the first one: decide who is accountable. In most organisations, the answer to "who owns AI risk?" is either unclear or defaults to IT. That is not sufficient. AI risk is an executive accountability problem, and the sooner that is made explicit, the faster everything else falls into place.
From there, build outward. Understand your impacts. Measure your risks. Create transparency. Test and monitor. Maintain human control. None of this requires a large team or a large budget. It requires intention, clarity, and leadership.
Australia is not behind on AI capability. The tools are the same everywhere. What differs is the governance foundations that allow businesses to move from experimentation to implementation with confidence. That is the gap worth closing. The businesses that close it first will not just be compliant. They will be the ones their partners and customers trust to scale.
